1. Subject matter

These Terms of Service (hereinafter "ToS") govern the use of the SPORTVISE platform, accessible at https://sportvise.ch (hereinafter "the Service"), published by Thomas Castella, sole proprietorship, with registered office in Switzerland (see Legal Notice).

Use of the Service implies full and unreserved acceptance of these ToS. Any person who does not accept all or part of these ToS must refrain from using the Service.

Each user may create only one personal account. Sharing an account between multiple persons is prohibited.

6. Plans, subscriptions, and payments

6.1 Available plans

SPORTVISE offers three plans whose features are detailed on the /abonnement page:

6.2 Payment terms

Payments are processed by Stripe Payments Europe Ltd., a PCI-DSS Level 1 certified provider. SPORTVISE never stores your banking information.

Subscriptions are automatically renewed at each due date (monthly or annually depending on the plan chosen) unless previously cancelled.

6.3 Cancellation by the user

You may cancel your subscription at any time from your dashboard ("Subscription" section). Cancellation takes effect at the end of the already-paid current period. No refund is due for the current period.

6.4 Price modifications

Any price change for existing plans will be notified to you by email at least 30 days before entry into force. You may cancel free of charge if you refuse the new pricing.

8. User content

8.1 Ownership

You retain full ownership of the Content you enter into SPORTVISE (journal notes, calendar events, recaps, messages to agents).

8.2 License granted to SPORTVISE

To enable the operation of the Service, you grant SPORTVISE a non-exclusive, worldwide, royalty-free, non-transferable license to use your Content, strictly limited to the following purposes:

8.3 Accuracy commitment

You warrant that your Content is accurate and that you have the right to enter it (in particular for images shared with the agents).

9. ⚠️ AI agent limitations — IMPORTANT

9.1 Nature of AI advice

The advice, recommendations, information, and analyses provided by SPORTVISE's AI agents are generated by language models (Claude by Anthropic) and are provided for informational and indicative purposes only.

This advice in NO WAY constitutes:

9.2 Reliability limitation

Artificial intelligence models may make mistakes, hallucinate information, or provide advice unsuited to your specific situation. SPORTVISE implements best practices to minimize these risks but cannot guarantee the absolute accuracy of AI agent outputs.

9.3 Obligation to consult a professional

For any important decision affecting your health, finances, legal or tax situation, you must consult a qualified and certified professional. SPORTVISE never substitutes for a doctor, lawyer, accountant, qualified nutritionist, or certified sports coach.

9.4 Medical emergencies

IN A MEDICAL EMERGENCY, DO NOT CONSULT THE AI AGENTS. Immediately dial:

10. Intellectual property

10.1 SPORTVISE's ownership

The entire Service (code, design, "SPORTVISE" trademark, logo, AI agent texts, dashboard structure) is the exclusive property of Thomas Castella or his licensors. Any reproduction, modification, distribution, or commercial exploitation of the Service or its elements is strictly prohibited without prior written authorization.

10.2 Trademarks

"SPORTVISE" and the agents' names (Lucas, David, etc.) are trademarks used by Thomas Castella. Their unauthorized use is prohibited.

11. Suspension, termination, and account deletion

11.1 Termination by the user

You may delete your account at any time from your dashboard or by sending a request to info@sportvise.ch. Your data will be deleted in accordance with the Privacy Policy (maximum 30-day delay).

11.2 Suspension or termination by SPORTVISE

SPORTVISE reserves the right to suspend or terminate an account without notice or refund in the event of:

Termination results in loss of access to the Service. Amounts paid for the current period remain acquired by SPORTVISE. Obligations that by their nature survive termination (liability, intellectual property, applicable law) remain in force.

12. Warranties and limitation of liability

12.1 Service provided "as is"

The Service is provided "as is" and "as available", without any express or implied warranty, in particular of merchantability, fitness for a particular purpose, or absence of error.

SPORTVISE does not warrant that:

To the fullest extent permitted by applicable Swiss law, the total liability of SPORTVISE towards a User is limited to the amount actually paid by that User in respect of the subscription during the 12 months preceding the triggering event.

SPORTVISE shall not be held liable for any indirect, incidental, consequential, or special damage, including loss of data, loss of revenue, damage to reputation, or harm resulting from a decision made on the basis of advice from the AI agents.

This limitation does not apply in case of wilful misconduct or gross negligence by SPORTVISE, in accordance with art. 100 para. 1 and 101 of the Swiss Code of Obligations.

13. Indemnification

You agree to indemnify and hold SPORTVISE harmless from any claim, damage, liability, cost, or expense (including reasonable attorney's fees) arising from:

14. Modifications to the ToS

SPORTVISE reserves the right to modify the ToS at any time. Any substantial modification will be notified to you by email at least 30 days before entry into force. Continued use of the Service after this date constitutes acceptance. If you refuse the new ToS, you may cancel your account free of charge.

15. Force majeure

SPORTVISE shall not be held liable for a breach resulting from a case of force majeure within the meaning of Swiss case law, in particular: third-party infrastructure failure (Supabase, Netlify, Anthropic), massive cyberattack, natural disaster, pandemic, governmental decision.

16. Applicable law and jurisdiction

These ToS are governed by Swiss law, excluding conflict-of-laws rules.

Any dispute relating to their interpretation or execution shall be subject to the exclusive jurisdiction of the ordinary courts of the Canton of Fribourg, subject to appeal to the Swiss Federal Supreme Court.

For consumers residing in the European Union, this clause does not preclude the jurisdictional protections applicable in their country of residence.

17. Miscellaneous provisions

17.1 Partial invalidity

If a provision of these ToS is judged null or inapplicable by a competent court, the other provisions remain in force and continue to produce their effects.

17.2 Entirety of the agreement

These ToS, together with the Privacy Policy and the Legal Notice, constitute the entire agreement between you and SPORTVISE and replace any prior agreement on the same subject matter.

17.3 Assignment

SPORTVISE may assign its rights and obligations under these ToS to a third party (in particular in case of business transfer or merger). This assignment may only be effective if it does not diminish your rights.
